Lease Agreement

The property will be ready for occupancy at 4:00 PM on the beginning date of the lease and must be vacated by 10:00 AM on the ending date of the lease. We will accommodate earlier check in and later check out if possible. Must be approved prior to stay to accommodate the cleaning staff.

Utilities: The lessor will provide utilities including water, heat, electric and WiFi.

Restrictions: No pets. No smoking. No one other than those listed on check-in form. Please respect these restrictions.

Accommodations: One queen bed, two full beds, one bunk bed, and one twin bed. One and half bathrooms. Linens and towels provided in lease.

Cancellation Policy: The required deposit will be refunded in full, less an advertising fee of $100, if the lessor is notified of cancellation at least thirty (30) days prior to Lessee’s scheduled arrival date. Should Lessee cancel within (30) thirty days of arrival date, the lessor will diligently try to fill the cancelled rental period. If the rental period can be filled, the deposit, less $100, will be returned. If the rental period cannot be filled, no refund will be given. There is no refund given after the lessee takes occupancy. If this is an AirBnB, HomeAway, or Booking.com rental, then the rules of the AirBnB, HomeAway, or Booking.com cancellation policy supersede this policy.

Other: LESSEE assures LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the press in good order and appearance, and will conduct themselves in a manner inoffensive to neighbors.

LESSEE agrees that any tenant who is found using illegal drugs or allows other use illegal drugs on the premises will be immediately denied continued occupancy at these premises.

LESSEE and/or their guest shall not disturb, annoy, endanger or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, not violate any law or ordinance, nor commit waste or nuisance on or about the premises.

LESSEE agrees that during the term of this lease, he/she will keep the leased premises clean and free of trash and other waste, and that all pipes, wires, glass, plumbing and other equipment and fixtures will be kept in the same condition as at the beginning of the lease.

LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants or guests, or from carelessness, neglect or improper conduct of any persons entering, occupying or visiting the leased premises.

LESSEE agrees that he/she will not paint or make any alterations to the property, including changing existing locks or adding new ones,

Upon not less than 24 hours notice, LESSEE shall make the premises available to LESSOR or his agent for the purpose of entering to make necessary or convenient repairs and to show the premises to prospective tenants. In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE

LESSEE may not let, sublet or assign this lease for all or any part of the premises for the duration of the lease.

If LESSEE abandons or vacates the premises, LESSOR may, at his option, terminate the lease, enter the premises and remove all property

In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived therefrom, the prevailing party shall be entitled to receive attorney’s fees as fixed by the Court in addition to all relief at law or equity.

Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.

LESSEE assumes full responsibility for fulfilling the terms of the lease for the period stated, and assures the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above, including any outstanding or unpaid charges that are the responsibility of the LESSEE.

LESSEE agrees to report promptly to LESSOR any mechanical, electrical, plumbing or other problems with the premises.

LESSEE agrees to release LESSOR and the Waterville Acres Homeowners Association from any liability do to common grounds and pool use.

LESSEE agrees to leave the premises neat and orderly, without excessive mess. A cleaning and linen service is included in the lease, and is the responsibility of the LESSOR. However, excessive disarray, causing added charges to the standard cleaning service, will result in a deduction from the security deposit or a claim to the property damage protection policy.
